A post-church grocery run in Norfolk, Va., ended in a fatal aisle confrontation for a 77-year-old shopper. Police say Bert Atienza died from head injuries a day after he was attacked inside a Walmart on June 7, allegedly by the parents of a 17-year-old store employee he had just argued with over a cart that nearly hit his wife, per the Guardian. According to local outlets, the teen phoned her parents, Travis White, 44, and Erika Mitchell, 42, who then found the couple and allegedly shoved and punched Atienza before he fell into a shelving unit and onto the floor. The attack, captured by surveillance video, also included one of the suspects allegedly kicking Atienza when he was down.
His death from blunt head trauma was ruled a homicide. White and Mitchell are jailed without bond on charges of second-degree murder, and their daughter faces multiple charges in juvenile court. Atienza's wife, Josephine, says the teen threw a can toward the couple after Bert complained that she had narrowly missed his wife with a heavy shopping cart and "did not even say excuse me or apologize," per WTKR. The 17-year-old, who no longer works for Walmart, watched as her parents attacked Atienza, police say. She'd called her parents "distraught," prompting them to go to the store to check that she was safe, White's attorney tells WTKR. He argues there may be evidence of simple assault, but "nothing that goes further than that."
