A Venezuelan delivery driver shot by an ICE officer in Austin is now hospitalized with paralysis on his left side, his attorney says. The attorney, Kate Lincoln-Goldfinch, has filed an emergency lawsuit seeking the immediate release of 30-year-old Wilber Garces Perez from immigration custody and a halt to his deportation to Venezuela, reports the Washington Post. A federal judge has ordered a Sept. 30 hearing with Perez to be present.

Lincoln-Goldfinch says Perez was moved from a hospital to a South Texas ICE facility four hours after being shot Sunday, despite a bullet lodged near his spine. He later reported sleeping on the detention center floor before being sent back to a hospital after losing movement on his left side, she says. DHS has previously said Perez was in the country illegally, per Reuters. He was working as a DoorDash driver when federal agents apprehended him, and supporters are demanding video of the incident.
