The timing is striking: McIver is fighting federal charges stemming from a 2025 oversight visit to Newark's Delaney Hall immigration detention center, where prosecutors say she struck two federal agents as they moved to arrest Newark Mayor Ras Baraka. She has pleaded not guilty and argues the Trump administration is targeting her for doing her job. An appeals court has allowed two of three counts to proceed, with a lower court still weighing the third.
The child's birth comes amid the 40-year-old congresswoman's openness about nearly a decade of fertility struggles, several surgeries, and an IVF journey that she said ended up dependent on her last embryo, notes ABC News. "People might find it crazy that even though I'm facing 17 years in prison, I made the decision to get pregnant," McIver wrote on X. "But, at the end of the day, this is something I couldn't let be consumed by this administration." McIver will take October off before returning to voting in November; she backs proxy voting for new parents.
