A North Dakota hospital is facing a lawsuit over an alleged newborn swap that plaintiffs say went unnoticed for more than three decades. Two men and their parents claim Unity Medical Center in Grafton sent each baby home with the wrong family after both were born there on Jan. 26, 1988—the only births at the hospital that day. The six plaintiffs, including Kyle Bylin and Jeremy Morrison, accuse the hospital of negligence, medical malpractice, deceit, and intentional and negligent infliction of emotional distress, and are seeking more than $50,000 in damages, per Valley News Live.
Morrison, who now lives in Colorado, describes himself as a "blonde-haired kid that stood out in a family full of brown-haired people," per KKTV. He says he took a DNA test in 2024, revealing his parents were not biologically related to him. His aunt reportedly also took a test that showed Bylin was her nephew. When she reached out to him, she learned his DNA test results had been confusing, indicating his mother had no biological connection to him, InForum reports. Both sets of parents have since met their biological sons, though Bylin and Morrison have not yet connected in person.
Unity Medical Center, formally Christian Unity Hospital Corporation, acknowledges the men "apparently were separated from their biological parents at some point during their lives," but denies responsibility and is asking a judge to toss the case with prejudice. The hospital's attorneys say staff used proper skill and care, but records from that time "no longer exist," and the claims may be barred by the statute of limitations, given the 36-year gap between the alleged mix-up and the lawsuit. They also raise comparative fault, suggesting others could bear responsibility if any harm is found. Both sides have requested a jury trial.
