Maurene Comey's ouster from the Justice Department wasn't just abrupt, it was illegal, a federal judge declared Monday. In a 55-page decision, Judge Jesse Furman of Manhattan's federal court ruled that the Trump administration unlawfully removed Comey in July 2025, violating separation of powers, federal administrative law, and her due-process rights, reports the New York Times. Comey, a veteran Manhattan prosecutor, had argued she was targeted because of her father, former FBI Director James Comey, and her perceived politics.
Furman said the government's contention that Congress is barred from regulating the removal of federal prosecutors "flies in the face of nearly two centuries of Supreme Court precedent," per the AP. "Indeed, to accept Defendants' argument would be to unsettle the very equilibrium established by this Nation's constitutional system," he wrote. Furman also said Comey, who worked on the Jeffrey Epstein case and other high-profile prosecutions, is owed back pay through December 2025.
