A Venezuelan delivery driver who was shot by an ICE officer in Austin, Texas, said on Monday that he was sitting in federal detention with a bullet still near his spine, ABC News reports. Speaking by phone from a Pearsall facility, 28-year-old Wilber Rafael Garces Perez told reporters he was "in a lot of pain" and claimed he had not received the medical care he needs after Sunday's shooting because ICE was pushing the hospital to release him to the agency's custody as quickly as possible, NBC News reports. By Monday night, his attorney said he had been returned to a hospital, the AP reports.
Garces Perez, who was working a DoorDash run at the time, says an unmarked SUV repeatedly struck his car and only activated lights and sirens after hitting him. He disputes a Department of Homeland Security statement that described a foot chase, saying he never left his vehicle until after he was shot. DHS has labeled him an "illegal alien" with a final deportation order; his attorney says he is in the country legally and seeking asylum. Austin's mayor blasted ICE over the incident, which has triggered protests, while a city councilmember says local police were blocked from processing the crime scene.
