Yes, they are shaped like pumpkins. No, they do not look like carved jack-o'-lanterns coming out of the package. Hershey has tweaked its label on Reese's Peanut Butter Pumpkins to clarify that point after a lawsuit, reports USA Today. "Carving not on actual product," the label now reads, a step up from the previous, "Decorating Suggestion." The move follows a Florida lawsuit that accused Hershey of misleading advertising, per NBC News. One person in the lawsuit says he "believed that the product contained a cool-looking carving of a pumpkin's mouth and eyes," according to court documents. Alas, the chocolates were blank.
A federal judge tossed the case in September, ruling that the only harm was the plaintiffs' "subjective disappointment" and noting that they still got edible Reese's. Plaintiffs, who had sought $5 million, may appeal. Hershey hasn't said whether its new wording is connected to the lawsuit.
