Captain in Fatal Capsizing Is Arrested by ICE

The man accused of piloting a boat that capsized in New York Harbor, resulting in the deaths of a Queens mother and her 5-month-old daughter, is now in immigration custody. US officials say 46-year-old Manuel Hernandez-Umana, a citizen of El Salvador, was detained by ICE after investigators determined he is in the country unlawfully, reports CNN. He had previously been released on a $50,000 bond following his August 9 arrest.

Hernandez-Umana faces federal charges of misconduct and neglect as a ship officer resulting in death, along with state counts including reckless endangerment, after the Yamaha AR210 he was operating capsized near the Statue of Liberty with 14 people aboard. Authorities allege he lacked proper licenses, exceeded capacity, and had no infant life vests. Hernandez-Umana also lied to a border officer when he entered the country in 2007 by claiming to be an American citizen, the Department of Homeland Security said Thursday, per the AP. He faces deportation after the criminal case concludes.
