Halle Berry's long-running custody battle with ex-husband Olivier Martinez has opened a new front, with the French actor asking a court for sole custody of their 12-year-old son, Maceo, and seeking a temporary restraining order against Berry, according to documents cited by People. Martinez, 60, alleges that Berry on Saturday "physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him," causing him "emotional and mental distress." Martinez claims there have been prior incidents of physical, verbal, and emotional abuse.
An attorney for Berry tells TMZ that the "filing is entirely meritless and deliberately misleading," adding that Martinez has "repeatedly violated court orders" for which he "has already been legally sanctioned." The filing includes texts Martinez says Berry sent about conflicts with Maceo and references to her MMA training and alleged chokeholds. Berry's fiancé Van Hunt was described in the documents as having defended the child during the disputed incident. The exes, who divorced in 2023 after a years-long process, currently share joint legal custody under an agreement that also requires Berry to pay child support.
